1. Scope of Services

These Terms & Conditions govern all excursions and experiences offered by Aqualux Bahamas, including but not limited to:

● Pirate Party Cruise (Code OCC57)
● Ocean Family Pirate Adventure (Code OCC56)
● Bahamian Sip & Paint by the Sea (Code OCC58)

By booking or participating in any Aqualux excursion, you agree to these Terms & Conditions in full.

2. Eligibility

● All Aqualux experiences are exclusively available to MSC cruise guests visiting Ocean Cay MSC Marine Reserve.
● Reservations must be made through the MSC Cruises booking platform, using the excursion codes provided.

3. Meeting Point & Duration

● All excursions depart from the Tour & Excursion Center at Ocean Cay MSC Marine Reserve.
● Guests are required to arrive at least 15 minutes prior to departure.
● Excursion durations are approximate and subject to weather, sea conditions, and port schedules.

4. Pricing & Payments

● Prices are set and managed by MSC Cruises.
● Payment is collected exclusively through MSC’s booking system.
● Aqualux does not accept direct payments for reservations.

5. Cancellations & Changes

● All cancellations, refunds, and rescheduling are subject to MSC Cruises’ policies.
● Aqualux reserves the right to cancel or modify excursions in the event of unsafe weather,
operational needs, or force majeure. In such cases, MSC’s policies on refunds or rebooking apply.

6. Guest Responsibilities

● Guests must comply with the age requirements for each excursion (minimum age of 6 years old for certain activities).
● Guests must follow all safety instructions provided by crew and instructors.
● Swimming activities are optional and at the guest’s own risk.

7. Liability

● Participation in excursions is voluntary. Aqualux is not liable for personal injury, loss, damage, or delays caused by factors beyond its control (including weather, wildlife, or port authority decisions).

● Guests assume responsibility for their own health, safety, and belongings during
excursions.

8. Indemnification

Guests agree to indemnify and hold harmless Aqualux, its staff, and partners from any claims or liabilities arising from non-compliance with safety instructions, misuse of equipment, or failure to meet excursion eligibility requirements.

9. Governing Law

These Terms & Conditions are governed by the laws of The Bahamas.
